Since 1951, India’s Sangh Parivar’s objective remained active and tried to abolish Article 370, When the RSS of India floated its political front as BJP (Bhartiya Janta Party). Indian Illegally Occupied Jammu and Kashmir and Kashmiri population is facing existential threat since the abrogation of Article 370. The BJP govt under PM Modi’s leadership abrogated Article 370 of the Constitution of India, Article 370 which guarantees the autonomy of the Kashmir region. The Indian Govt. Abrogated Article 370 through a direct presidential order. Now Kashmir will be ruled directly from Delhi along with “Jammu, “Union Territory” status has been changed and the special status and unique Identification of Indian Illegally occupied Jammu and Kashmir is finished. Kashmir’s constitution was designed by its elected Assembly members in 1951-1956, India’s Parliament or govt. has no authorization or jurisdiction to amend or repeal this article.

Indian Govt’s Home Minister Amit Shah promised to the Kashmiri native to reverse the matter but after a fresh pole, this promise too emerged as a fairy tale of the Indian govt. The Indian govt. also constituted a delimitation boundary commission, which will revise the boundaries of constituencies that elect the legislative assembly member. After revising the boundaries of constituencies, Muslim majority areas will be divided and merged with Hindu majority areas to change the demographic structure. After this demographic structure change in the Muslim majority area of Kashmir, Chief Minister will be nominated by Jammu and rule all Muslim majority areas.

The decision of redrawing these boundaries in Jammu and Kashmir was carried out by the Delimitation Commission which came into being on 6th March 2020, only six months after the abrogation of Kashmir’s special status on 5th August 2019. The redefining of electoral boundaries by the Commission is a tragedy in itself. The Commission recently issued a list increasing the number of seats in the Indian Illegally Occupied Jammu and Kashmir (IIOJK) from 83 to 90. This includes 6 constituencies which will be in the Hindu-majority Jammu region and one in the Muslim-majority Kashmir region. It is tragic as Jammu has 37 seats and Kashmir holds 46 seats. The Commission proposed increasing the number of seats to 43 and 47 respectively.

The Indian Objective behind the abrogation of Article 35-A is to change the demographic structure of the Jammu and Kashmir valley based on Israel’s model. India planned to settle non-Local people from India in Valley to change the Muslim majority into a minority. Native Kashmiris are afraid of this decision because building new colonies in the disputed area and adopting Israel’s model of occupation will create a stronghold for Indian Forces in the valley. While currently in Kashmir Valley there is a ratio of 1:8, 1 Military person for 8 civilians. Which labelled Kashmir as one of the most militarized zones in the region.

The Indian govt. is controlling Internet services and denying active 4G services in the valley to control access of Kashmiri with the world. Without Internet and Mobile services Kashmiri peoples are unable to raise their issues with the global world. After the death of Kashmir Hurriyat Leader Syed Ali Gillani, Indian forces didn’t allow the Gillani Family to organize the funeral of Ali Gillani.

India plans to hold a meeting of G-20 countries in Jammu and Kashmir valley which is against the UN Security Council’s resolutions, which declared India Illegally Occupied Jammu and Kashmir as a disputed territory. Pakistan openly criticizes the decision to hold the G-20 meeting in Jammu and Kashmir, Ministry of Foreign Affairs (MOFA) Pakistan said any attempt to change the status of Indian Illegally occupied Jammu and Kashmir is unacceptable, and the international community must restrain from participating in such activities those are against the International Law.

Abrogation of Article 370 is Unconstitutional, Article 37 provides autonomy to the Jammu and Kashmir to take decisions unilaterally other than Defence, Economy, and Foreign Affairs. Indian step to abolish Article 370 is also against the UN Security Council Resolutions UNSCR 38,47,51,91, and 122. The Indian Act to abolish Article 370 is against the “Shimla Agreement” between Pakistan and India.

Large-scale fighting continues throughout Kashmir and military operations by regular armed forces against the freedom fighters stop them from fighting for their rights. Kashmir Freedom Movement has been fighting for their rights for the last 7 decades, and after the abrogation of Article 370 Kashmir Freedom Movement received a new spark when youth started joining the campaign massively.

Pakistan raised its concern regarding the abrogation of Article 370 globally by contacting different embassies of countries from different regions and sharing proofs of Indian Illegal activities. Pakistan stated its stance that these kinds of unilateral acts by the Indian Govt. under the BJP regime are against the will of Kashmiri natives and will cause grief consequences on regional stability. Different countries including Turkey, Malaysia, China, the UK, etc., express their concerns over the current situation of Indian Illegally Occupied Jammu and Kashmir and demand a peaceful resolution of the Kashmir issue by consensus of Kashmiri peoples and UN resolutions.
